# Cookie Policy

This Cookie Notice explains how 2Hero AB (org. 559476-1388), a Swedish corporation, and its subsidiaries (collectively, “2Hero”, “we”, “us”, and “ours”) use cookies and similar technologies to recognize you when you visit, interact with or use any of 2Hero domains and/or any of Cillers websites which make reference to this Cookie Policy (”Policy”), including [https://www.2hero.dev ](https://www.2hero.dev/)(“Websites”), as well as in the course of business, such as in connection with our events, sales and marketing activities (collectively, “Business Activities”). It explains what these technologies are and why we use them, as well as your rights to control our use of them.

## **1. What are cookies?**

Cookies are small data files that are placed on your computer or mobile device when you access a website. Cookies allow websites to recognize your device next time you visit, and track your use of the digital property, browsing history, personal preferences, and interests, and improve and customise your browsing experience. Cookies may contain or transmit unique identifiers that are considered personal information under certain data protection laws, such as IP address, device information, and website usage.

Cookies set by the website owner (in this case, 2Hero) are called “first party cookies”. Cookies set by parties other than the website owner are called “third party cookies”. Third party cookies enable third party features or functionality to be provided on or through the website (e.g., advertising, interactive content, and analytics). The parties that set these third party cookies can recognize your device both when it visits the website in question and also when it visits certain other websites.

## **2. What kind of cookies does 2Hero use and what do they do?**

The types of cookies served through our Websites and the purposes they perform are described in the table below:

| Types of cookie | Who serves these cookies |

## **3. What about other tracking technologies?**

Cookies are not the only way to recognize or track visitors to a Website. We may use other, similar technologies from time to time, like web beacons (sometimes called “tracking pixels” or “clear gifs”) or JavaScript (placed within the code of our Websites, which activate when you request an HTML page with JavaScript in it). Web beacons are tiny graphics files that contain a unique identifier that enable us to recognize when someone has visited our Websites, clicked certain links, or opened an e-mail that we have sent them in connection with a Business Activity. These technologies allow us, for example, to monitor the traffic patterns of users from one page within our Websites to another, to deliver or communicate with cookies, to understand whether you have come to our Websites from an online advertisement displayed on a third party website, to improve site performance, and to measure the success of email marketing campaigns, as Web beacons tell if an email has been opened and acted upon. Unlike cookies, which are stored on the user’s hard drive, web beacons are typically embedded invisibly on web pages (or in an email). In many instances, these technologies are reliant on cookies to function properly, and so declining cookies will impair their functioning.

We may also use “device fingerprinting” or “browser fingerprinting”. This technology is used to identify particular machines or browsers in order to detect and prevent fraud and for information and network security. Declining cookies may not affect device or browser fingerprinting.

## **4. Do you serve targeted advertising?**

Third parties may serve cookies on your computer or mobile device to serve advertising through our Websites and/or other websites. These companies may use information about your visits to our Websites and other websites in order to provide relevant advertisements about goods and services that you may be interested in. They may also employ technology that is used to measure the effectiveness of advertisements. This can be accomplished by using cookies or web beacons to collect information about 5 your visits to our Websites and other sites in order to provide relevant advertisements about goods and services of potential interest to you.

Information collected may be used, alone or in combination with information about you we obtain from other sources (like our data partners and offline customer data), to among other things, deliver advertising targeted to your interests, including to serve ads related to our products or services when you access and use other websites and to better understand the usage of the Websites tracked by these third parties. This Policy does not apply to, and we are not responsible for, cookies or clear gifs in third party ads, and we encourage you to check the privacy policies of advertisers and/or ad services to learn about their use of cookies and other technology. If you would like more information about this practice and to know your choices about not having this information used by these companies, please visit [www.aboutads.info/choices](https://www.confluent.io/cookies/www.aboutads.info/choices) or [www.youronlinechoices.eu](https://www.confluent.io/cookies/www.youronlinechoices.eu).

## **5. How can I accept or reject cookies?**

You have the right to decide whether to accept or reject cookies. When you visit our Websites, depending on where you are located, we may show you a notice which tells you how and why we use certain cookies and provide you the ability to opt out of certain cookie use (other than Strictly Necessary Cookies). You can also control cookies by changing the setting for each category via the Cookie Settings at the footer of 2hero’ website or by setting or amending your web browser controls to accept or refuse all cookies. As the means by which you can refuse cookies through your web browser controls vary from browser to browser, you should visit your browser’s help menu for more information. If you choose to reject cookies, you may still use our website, though your access to some functionality and areas of our website may be restricted.

The third-party advertising partners with which we work may be members of the Network Advertising Initiative or the Digital Advertising Alliance. For more information about cookies, and how to disable interest-based advertising cookies from participating companies, please visit [About Ads](https://optout.aboutads.info/?c=2\&lang=EN). Without limiting the foregoing, 2Hero, its subsidiaries, its affiliates, and its licensors do not warrant that the content is accurate, reliable or correct; that the Website will meet your requirements; that the Website will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the Website is free of viruses or other harmful components. Federal law, some states, provinces and other jurisdictions (”Jurisdictions”) do not allow the exclusion and limitations of certain implied warranties, so the above exclusions may not apply to you. This Agreement gives you specific legal rights, and you may also have other rights which vary from state to state. The disclaimers and exclusions under this Agreement will not apply to the extent prohibited by applicable law.

## **9. Limitation of Liability**

To the maximum extent permitted by applicable law, in no event shall 2Hero, its affiliates, agents, directors, employees, suppliers or licensors be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this Website. Under no circumstances will 2Hero be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the Website or the information contained therein.

To the maximum extent permitted by applicable law, 2Hero assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Website; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (iv) any interruption or cessation of transmission to or from the Website; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Website by any third party; (vi) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Website; and/or (vii) user content or the defamatory, offensive, or illegal conduct of any third party. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

## **10. Governing Law, Arbitration, and Class Action/Jury Trial Waiver**

### **A. Governing Law**

You agree that: (i) the Website shall be deemed solely based in Sweden; and (ii) the Website shall be deemed a passive one that does not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than Sweden.

This Agreement shall be governed by the internal substantive laws of Sweden, without respect to its conflict of laws principles. Notwithstanding the preceding sentences with respect to the substantive law, any arbitration conducted pursuant to the terms of this Agreement shall be governed by the Swedish Arbitration Act (SFS 1999:116).

The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

You agree to submit to the personal jurisdiction of the courts located in Stockholm, Sweden for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights, as set forth in the Arbitration provision below, including any provisional relief required to prevent irreparable harm. You agree that Stockholm, Sweden is the proper forum for any appeals of an arbitration award or for trial court proceedings in the event that the arbitration provision below is found to be unenforceable.

### **B. Arbitration**

Read this section carefully because it requires the parties to arbitrate their disputes and limits the manner in which you can seek relief from 2Hero. For any dispute with 2Hero, you agree to first contact us at <hello@2hero.dev> and attempt to resolve the dispute with us informally. In the unlikely event that 2Hero has not been able to resolve a dispute it has with you after sixty (60) days, we each agree to resolve any claim, dispute, or controversy (excluding any claims for injunctive or other equitable relief as provided below) arising out of or in connection with or relating to this Agreement, or the breach or alleged breach thereof (collectively, “Claims”), by binding arbitration by The Stockholm Chamber of Commerce Arbitration Institute ("SCCAI"), under the Optional Expedited Arbitration Procedures then in effect for SCCAI, except as provided herein. SCCAI may be contacted at [https://stockholmshandelskammare.se/en/scc-arbitration-institute](https://stockholmshandelskammare.se/en/scc-arbitration-institute/). The arbitration will be conducted in Stockholm, Sweden, unless you and 2Hero agree otherwise. If you are using the Website for commercial purposes, each party will be responsible for paying any SCCAI filing, administrative and arbitrator fees in accordance with SCCAI rules, and the award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys’ fees and reasonable costs for expert and other witnesses. If you are an individual using the Website for non-commercial purposes: (i) SCCAI may require you to pay a fee for the initiation of your case, unless you apply for and successfully obtain a fee waiver from SCCAI; (ii) the award rendered by the arbitrator may include your costs of arbitration, your reasonable attorney’s fees, and your reasonable costs for expert and other witnesses; and (iii) you may sue in a small claims court of competent jurisdiction without first engaging in arbitration, but this does not absolve you of your commitment to engage in the informal dispute resolution process. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall be deemed as preventing 2Hero from seeking injunctive or other equitable relief from the courts as necessary to prevent the actual or threatened infringement, misappropriation, or violation of our data security, Intellectual Property Rights or other proprietary rights.

### **C. Class Action/Jury Trial Waiver**

With respect to all persons and entities, regardless of whether they have obtained or used the Website for personal, commercial or other purposes, all claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class action, collective action, private attorney general action or other representative proceeding. This waiver applies to class arbitration, and, unless we agree otherwise, the arbitrator may not consolidate more than one person’s claims. You agree that, by entering into this Agreement, you and 2Hero are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or other representative proceeding of any kind.

## **11. General**

### **A. Assignment**

This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you without our prior written consent, but may be assigned by 2Hero without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

### **B. Notification Procedures and Changes to the Agreement**

2Hero may provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through posting of such notice on our Website, as determined by 2Hero in our sole discretion. 2Hero reserves the right to determine the form and means of providing notifications to our Users, provided that you may opt out of certain means of notification as described in this Agreement. 2Hero is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us. 2Hero may, in its sole discretion, modify or update this Agreement from time to time, and so you should review this page periodically. When we change the Agreement in a material manner, we will update the ‘last modified’ date at the bottom of this page and notify you that material changes have been made to the Agreement. Your continued use of the Website after any such change constitutes your acceptance of the new Terms of Use. Any changes will take effect 30 days after they are posted. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Website.

### **C. Entire Agreement/Severability**

This Agreement, together with any amendments and any additional agreements you may enter into with 2Hero in connection with the Website, shall constitute the entire agreement between you and 2Hero concerning the Website. There are no third-party beneficiaries to this Agreement. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. This Agreement will be binding upon and inure to the benefit of the parties hereto, their successors, and permitted assigns. Except set forth in the section above entitled “Changes to Agreement”, all amendment to this Agreement must be made in writing signed by both parties.

### **D. No Waiver**

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and 2Hero's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

### **E. Contact**

Please contact us at <hello@2hero.dev> with any questions regarding this Agreement.

# Community Code Of Conduct

Welcome to The 2Hero Community (”Community”), hosted by 2Hero AB (org 559476-1388), a Swedish corporation, and its subsidiaries (“2Hero,” “we,” or “us”).

2Hero is dedicated to providing the best community experience possible for all Community participants (”Participants”). Our goal with the Community is to foster knowledge sharing, sparking inspiration and providing a supportive environment for all that want to build better software systems faster. All are welcome to join, from beginner to expert.

The 2Hero Community Code of Conduct (”Code of Conduct”) governs how we all behave in this Community.

**Please report misconduct and inappropriate behavior to** [**community@2hero.dev**](mailto:community@2hero.dev)**.**

## **Expectations For All Community Participants**

### Be Welcoming

All Participants should feel welcome. Please make the extra effort to welcome new Participants and help everyone to feel included in our Community.

### Be Kind And Loving Toward All

We expect all Participants to be kind and loving to all.

When resentments and negative judgements arise, we have the opportunity to learn and upgrade our old ideas. We are patient and open to learning from other’s perspectives.

### Be Of Service

Our objective is that all Participants get what they need to be able to participate in a nice and productive way. We ask all Participants to be on the lookout if there is anyone that seems to need anything that you can help them with.

Eg. If you spot someone standing alone, please go to them and have a chat and introduce them to others. This is one of the simplest, yet most valuable and rewarding, actions you can take.

We welcome all Participants to be part of our group of volunteers (”Volunteers”). This is an excellent opportunity to have a good time, learn how to run great events and network. We have lots of different services commitments, from welcoming guests in the entrance to helping out with technical support at our hackathons. We also organize special dinners for our Volunteers.

### Ask For Service

It is much easier for others to be of service if you ask for help or assistance when you need it.

### **Be Conscientious**

We are fortunate to have sponsors that invest a lot of money, volunteers that invest their time and location partners that offer their office space to our Community. Let’s appreciate their contribution by showing up and being on time.

**Show up, if you sign up!** Our events are very popular and usually we have a long waiting list. So if you sign-up for our events but don’t show up, you are likely preventing someone else from participating.

The prevalence of registered participants that don’t show up has forced us to oversubscribe our events, which has, in some rare instances, led to us having to block a few late-comers at the door, because of fire security policies. And, in many other cases, it has led to empty chairs at our events while some that would really like to attend are stuck on the waiting list.

Please unregister as quickly as possible when you become uncertain that you can attend an event so we can open up the possibility for others to register. If you unregister the day before or the same day as the event, it will be hard for others to make last minute arrangements to be able to attend the event.
